In a press release, Journalists for Democracy in Sri Lanka (JDS) state that “people of Sri Lanka are deprived of their right to information and media, and journalists are forced to practise unprecedented levels of self censorship”.

Since the United Peoples Freedom Alliance (UPFA) government came into power in April 2004 with the present President Mahinda Rajapaksa as its prime minister, there has been an increase in killings, abductions, intimidation and threats against journalists and the media, JDS said.

50 journalists ‘exiled’

It has resulted in more than 50 journalists leaving the country due to fear of persecution.

The organisation had also published a list of 34 media workers killed since 2004.

When asked why the organisation is blaming the government since the Tamil Tigers were blamed for some of the killings, the coordinator of JDS, Rohitha Bashana Abeywardhana said, “The Tamil Tigers no longer exist, it is the responsibility of the government to investigate the killings and find the perpetrators. Since that is not done, we have no one else to blame”.

JDS supports the 11-point plan put forward last week by International Press Freedom Mission to redress the press freedom environment in Sri Lanka.

The organisation calls upon the United Nations, governments and other international organisations to put pressure on the Sri Lankan government “to end the culture of impunity and to bring the perpetrators of these crimes to justice.”

JDS is a group of journalists, writers, artists and human rights defenders who having left Sri Lanka, convened recently in Europe and campaign for human rights and media freedom in Sri Lanka.

SRI LANKA: Police officers torture and frame a young man who has been
in remand prison for a year

ISSUES: Fabricated charges; torture

Dear friends,

The Asian Human Rights Commission (AHRC) has learned that a young man
was taken into a police station and tortured after he displeased local criminals. He was reportedly framed while in custody, fabricated charges were taken against him and he has been in remand prison since April 2008. The case suggests cooperation between an illegal network of alcohol vendors and the police.

CASE DETAILS: (According to the victim and his mother)

According to information we have received, Lectchchaman Punyamoorthi
(21) angered a ring of illegal alcohol vendors early last year when he asked them to stop selling to his father, who he says was a heavy drinker and prone to domestic violence.

On April 5, 2008 the group abducted Puniyamoorthy and took him from
his home to an abandoned house, where he was tied with up a rope and
forced to drink their alcohol. The group called the police and accused Puniyamoorthy of selling it himself.

According to the victim he was tortured at the police station shortly
after his arrest: he was forced to remove his clothes and his legs were beaten; he was pushed face down on a bench and had his back beaten with a pole; his head was submerged repeatedly in cold water.

The police officers also reportedly forced the victim to handle an empty box, into which they put a hand grenade. The next day Puniyamoorthy was taken to the Matale magistrate court and accused of carrying explosives, with his fingerprints on the box used as evidence. Since this is a serious offence under the explosives ordinance Puniyamoorthy was sent into remand without bail. The police have filed two cases, B 362/08 and B 360/08 against him and the victim has been in the Rajaveediya Kandy remand prison since April 11, 2008.

ADDITIONAL COMMENTS:

This is not the first time the officers at Rattota police station have been accused of misconduct. The Asian Human Rights Commission is still awaiting an explanation into officers’ inept investigation into one child rape allegation (UAC-330-2007 <http://www.ahrchk.net/ua/mainfile.php/2007/2680/), in which they appeared to favour the accused, and into another (AHRC-UAC-048-2009 <http://www.ahrchk.net/ua/mainfile.php/2009/3155 ), in which the accused rapist was barely investigated and remains at large.

Sri Lankan citizens are protected from torture in sections 11, 12 and 13 of the Democratic Constitution of Sri Lanka, and under CAT, the UN convention against torture, the government is obliged to punish any
perpetrator of such crimes with at least seven years imprisonment or
a minimum penalty of Rs10,000. The convention was adopted by Sri
Lanka in 1994 but remains under-implemented.

SUGGESTED ACTION:

Please write to the local authorities listed below and demand that due disciplinary and legal action be taken against the officers at Rattota Police Station who have engaged in torture and fabricated charges, and that an investigation be started into the officers’ for misconduct. Please ask for the intervention of the National Human Rights Commission and National Police Commission to ensure that the victim receives a swift and fair trail and adequate compensation for torture, and that they take action to ensure that the authorities’ duties under CAT are more widely followed and understood.

The AHRC has written a separate letter to the UN Special Rapporteur
on the Question of Torture calling for an intervention into this
case.

இலங்கை வாழ் தமிழ் மக்களின் அவலநிலைக்கு விடிவுகாண, வழிவகை செய்ய புலம்பெயர் தமிழர்களுள்  சிந்தனையாளர்களின் அவை ஒன்றிற்கான கருவூலப்பத்திரம்.

1. அறிமுகம்.

யுத்தத்தின் பின் இலங்கைவாழ் தமிழரின் நிலைமையும் அவர்களின் எதிர்காலழும் கவலைக்குரியதாக இருக்கிறது. ஆதனால் இவ்விடையத்தில் அக்கறை கொண்டுள்ள புலம்பெயர்ந்த தமிழர்கள் மத்தியில் உள்ள அறிவாற்ரல் மிக்கோரின் சந்திப்பு ஒன்று அவசியமானது. இந்த அவசியத்தை நிறைவேற்ர ஒர் அவை தேவை. அப்பேர்பட்ட அவையின் நிர்மாணத்தன்மைபற்றி இவ் ஆவணம் முன்கூறமுனைகின்றது. அச்சந்திப்பில் அக்கற்றறிந்தவர்கள் இலங்கைத் தமிழ் மக்களின் தற்போதய நிலையில் உதவ எப்படிப் பங்களிக்கலாம் என்பதை ஆராயமுற்படுவதும் இந்த கருவூலப்பத்திரத்தின் நோக்கமாகும்.

புலம்பெயர்ந்த தமிழ் மக்களுள் கடந்த கால நிகழ்வுகளின் சரி, பிழை பற்றி விமர்சிப்போர் எம்மத்தியில் உள்ளனர் என்ற நிலையை ஏற்றுக்கொண்டு அப்பேற்பட்ட அனைவரையும் ஒன்றிணைத்து பக்கச்சார்பற்ற நடுநிலைமையைக் கொண்ட கற்றறிந்த தமிழர்களின் அவை தமிழர்களுக்காக செயற்பட வேண்டியது அவசியம் எனக் கருதப்படுகின்றது.

2.இலக்கு.

இலங்கைத் தமிழர்கள் தாங்கள் வாழ்ந்த பாரம்பரிய பூமியில் சுயகௌரவத்துடனும் ஒரு ஜனநாயக  சமூகத்தில் பிரஜைகள் அனுபவிக்கும் சகல உரிமைகளையும் கொண்ட ஒரு சமூகம் ஆக வாழ்வதற்கு வழிவகை செய்தல்.

3.நோக்கம்.

1.    ஆரம்ப கட்டமாக ஐரோப்பாவில் வாழும் புலம்பெயர்ந்த தமிழர்கள் சகலரையும் பிரதிநிதிப்படுத்தக்கூடிய பக்கச்சார்பற்ற சிந்தனையாளர் அவை ஒன்றை அமைத்தல்.

2.    புலம்பெயர்ந்த தமிழர்கள் மத்தியில் தமிழர்களின் விடயங்கள் பற்றிய கருத்து வேறுபாடற்ற விடயங்களை அடையாளம் காணல்.

3.    அங்கத்தவர்களைப் பிளவு படுத்தக்கூடிய கருத்து வேற்றுமை உள்ள முக்கியமான விடயங்களை வேண்டுமென்றே கலந்துரையாடுவதைத் தவிர்த்துக்கொள்ளல். அவ்வாறு செய்வதன் மூலம் குறித்த கருத்து வேற்றுமை உள்ள விடயங்கள் பற்றிப் பேசுவதில்லை என்பதில் இணக்கம் கொண்ட ஒரு ஐக்கிய அவையை உருவாக்குதல்.

4.    குறித்த அவை தமது இலக்கை அடைவதற்கு சர்வதேச நிபுணர்களின் ஆலோசனையைப் பெற்று குறித்த இடைவேளைகளில் சந்தித்து தமது இலக்கை அடைவதற்கான வழிவகைகளை நிர்ணயித்துக்கொள்ளல்.

5.    மேற்குறித்த இலக்கைக் கொண்ட வேறு அமைப்புக்களுடன் கூட்டுச் சேர்ந்து செயற்படுதல்.

4. வழிமுறைகள்.

1.    மேலே குறிப்பிட்ட நோக்கங்களை அடைவதற்கு ஐரோப்பாவில் உள்ள ஒவ்வொரு நாட்டிலும் கற்றறிந்த தமிழர்களைக் கொண்ட ஒரு நடுநிலைமையான சிந்தனையாளர் அவை ஒன்றை உருவாக்க ஊக்குவித்தல். இவ்வகையான சிந்தனையாளர் அவை உச்சநிலை சிந்தனையாளர் அமைப்பொன்றிற்கு கருத்தூட்டும் “தளநிலை அமைப்பு” ஆக இருக்கும்.

2.    இவ்வகையான ஒவ்வொரு “தளநிலை சிந்தனையாளர்” அமைப்பும் தெரிவு செய்யப்பட்ட செயற்குழு ஒன்றையும், தலைவர் ஒருவரையும் கொண்டதாக இருக்கும்.

3.    இவ்வகையிலான தளநிலை அமைப்புக்கள் குறித்த இடைவேளைகளில் சந்தித்து சொல்லப்பட்ட இலக்குகளோடு சம்பந்தப்பட்ட விடயங்களைக் கலந்துரையாடித் தீர்மானம் எடுக்கும்.

4.    அவ்வாறு எடுக்கப்போகும் தீர்மானங்களை தமது பிரதிநிதிகள் மூலம் உச்சநிலை சபைக்கு அதன் அடுத்த கூட்டத்தில் முன்வைக்கும்.

5.    ”தளநிலை சிந்தனையாளர்களின்” செயற்குழுவில் இருந்து 3 உறுப்பினர்கள் ஐரோப்பாவின் உச்சநிலை அமைப்பின் குறித்த நாட்டின் சிந்தனையாளர் குழுவின் பிரதிநிதிகளாக இருப்பர்.

6.    இவ்வகையில் உருவாகும் உச்சநிலை அவை குறித்து இடைவேளைகளில் சந்தித்து அவ்வப்போது எழும் விடயங்களைக் கலந்தரையாடி இலக்கை அடைவதற்கான வழிமுறைகளை நிர்ணயிக்கும்.

5. பொதுக்குறிப்புகள்.

இக்கருத்தில் நுட்பங்களை அலசி ஆராய ஏதேனும் ஒரு நடைமுறையில் உள்ள அமைப்பு வழிவகை செய்யும் என எதிர்பார்க்கப்படுகின்றது. இக்கருத்திற்கு இணக்கம் ஏற்படின் அதற்கென ‘கருத்துப் பரிமாற்றப் பட்டறை’ ஒன்றை நடாத்தி இவ் ஆலோசனைகளின் நுட்பங்களை ஆராய்ந்து நிறுவன நடைமுறை ஒழுங்குகளையும் தயாரித்து குறித்த அமைப்புக்களை பதிவு செய்வதற்கான ஏற்பாடுகளை செய்து கொடுக்கும்.

கவனத்தில் கொள்ள வேண்டிய விடயங்கள்:

1.    ஐரோப்பாவில் உள்ள நாடுகளில் ஒவ்வொன்றிலும் சகல தமிழர்களுடைய கருத்துக்களையும் பிரதிநிதித்துவப்படக்கூடிய சிந்தனையாளர்களை ஒன்றிணைத்துக் குழுக்களை அமைக்க முயற்சித்தல். இவ்வகையில் உருவாகும் ஐரோப்பாவின் உச்சநிலை அமைப்பு ஏனைய கண்டங்களில் வாழும் தமிழர்களின் சிந்தனை அமைப்பு அமைய முன்மாதிரியாக இருக்கும் என எதிர்பார்க்கப்படுகின்றது.

2.    குறித்த சிந்தனையாளர் குழுக்களை அமைக்கும் போது தள மட்டத்திலும், உச்ச மட்டத்திலும் இக்குழுக்கள் புலம்பெயர்ந்த தமிழ் பேசுபவர்களுள் போதிய எண்ணிக்கையிலான மகளிரையும் சேர்த்துக்கொள்வதில் கவனம் செலுத்தப்பட வேண்டும்.

3.    இவ் அமைப்புகள் சகலவற்றிலும் தமிழர்களின் பிரச்சினை தொடர்பான கடந்த காலத்தில் நடைபெற்ற எந்த ஒரு விடயத்தைப் பற்றியும் பேசுவதோ, கலந்துரையாடுவதோ இல்லை என்ற ஒழுங்கு விதியை கடைப்பிடித்தல் வேண்டும். இவ்வாறு ஒழுங்கத்தவறின் எமது நோக்கத்தை அடைவதற்கான செயற்பாடுகளில் பாதகம் ஏற்படும்.

4.    கலந்துரையாடல்கள், கருத்துப் பரிமாறல் முதலியவைகள் ஆங்கிலத்திலோ, தமிழிலோ நடத்தக்கூடியதாக இருத்தல் வேண்டும். ஆங்கிலத்தில் தேவைப்படின,; தமிழில் சமகாலத்தில் மொழிபெயர்ப்பதற்கான ஒழுங்குகள் இருத்தல் வேண்டும். கூட்டப்பதிவுகள் ஆங்கிலத்தில் இருந்தால் சர்வதேச தொடர்புகளுக்கு இலகுவாக இருக்கும்.

5.    தேவையேற்படும் தருணத்தில் கருத்துப் பட்டறைக்கோ அல்லது வேறு எந்தக் கூட்டத்திற்கோ அனுபவம் வாய்ந்த சர்வதேச நிபுணர்களைப் பங்கு கொள்ளச் செய்யலாம்.

6.    எத்தறுவாயிலும் எக்கூட்டத்திற்கும் சிறப்பு சொற்பொழிவாற்ற கலாநிதி இயன்மாட்டின், சேர் நைஜல்றொட்றி போன்ற நிபுணர்களை அழைத்துக்கொள்ளலாம்.

We also raise our serious concern about the safety and welfare of the civilian population of the Vanni who have been repeatedly displaced in recent months and have suffered untold hardship fleeing aerial bombardment and artillery shelling with inadequate access to food, shelter and medicine.

The LTTE is responsible for forcing the civilian population to retreat with them into parts of Mullaitivu under its control. Here the Red Cross and United Nations estimate that around 250,000 civilians are currently trapped in and around the direct line of the GOSL military offensive and the firing line of the LTTE. We have received reports that any attempt to leave this area carries the risk of death at the hands of the LTTE who are using these civilians as human shields.

However, the “safe zone” established by the GOSL is inadequate. The civilians who managed to escape to the safe zone face extreme risk and have become victims of indiscriminate fire. The GOSL claims that such bombardment is in response to LTTE artillery firing from near the safe zones; this does not justify the GOSL’s actions and such claims reveal the GOSL’s determination to pursue its war agenda at any cost.  Furthermore, the GOSL should take immediate steps to show that it is concerned about the fate of Tamil civilians, including the rights of those who flee Mullaitivu.

Recognising the grave dangers to civilians, the Bishop of Jaffna, Rt. Rev. Dr. Thomas Savundaranayagam in a letter dated 25 Jan 2009 to the President urging larger safe zones, has made the following plea:

“We are also urgently requesting the Tamil Tigers not to station themselves among the people in the safety zone and fire their artillery-shells and rockets at the Army. This will only increase more and more the death of civilians thus endangering the safety of the people. I insist that both parties must observe the safety zone strictly.”

The LTTE’s use of civilians as human shields and deadly efforts to prevent civilians fleeing the war zone are unacceptable and clearly violate the laws of war.  Despite this, it is the Sri Lankan state’s duty to ensure the safety and protection of all of its citizens.  Civilian protection must take priority over military objectives. The GOSL should immediately prioritize addressing the escalating number of civilian deaths, the inability of injured civilians to reach areas of safety and medical care, and the sheer fear and terror experienced by the trapped civilian population.

The international community, as evident from their statements on the humanitarian situation, is aware of the mounting humanitarian catastrophe.  There needs to be further concerted international pressure to prevail upon the GOSL and the LTTE to ensure the safety of the civilian population.

We therefore appeal to the United Nations and the UN Agencies, governments engaged with the humanitarian situation in Sri Lanka including the State Government of Tamil Nadu, and international humanitarian organizations to:

•    pressure the GOSL to create additional and more effective safe zones;
•    demand that the GOSL and the LTTE establish corridors of safety with associated cessation of hostilities in areas necessary to allow for the safe passage of civilians to secure areas;
•    demand that international organizations such as UNHCR and ICRC are given full access to provide adequate care for the civilian population;
•    demand that neither the armed forces nor armed groups violate the rights of the displaced civilians arriving in government controlled areas;
•    demand that both the GOSL and the LTTE ensure the Geneva Conventions are adhered to in the treatment of civilians; as well as any LTTE cadres that surrender or are captured by security forces and members of the security forces captured by the LTTE, including the right to life and humane treatment of the prisoners of war.
